Wave, LLC (“Wave”, “we”, “us”, or “our”). By accessing our website or purchasing our products, you
agree to be bound by these Terms.
2. Product Disclaimer
IMPORTANT: These statements have not been evaluated by the Food and Drug Administration.
Our products are not intended to diagnose, treat, cure, or prevent any disease.
● Do not operate vehicles or heavy machinery after consuming our products
● Effects may be delayed up to two hours
● Do not use if you are pregnant, nursing, or planning to become pregnant
● Certain medications may interact with our products
● Consult your physician before use if you are taking any medications or have a medical condition
● Individual tolerance varies – start with the lowest recommended dose

9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:

● We disclaim all warranties including merchantability, fitness for a particular purpose, and
non-infringement
● We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages
arising from your use of our products
● We specifically disclaim liability for loss of profits, loss of data, business interruption, or any other
commercial damages
● Our total liability shall not exceed the amount you paid for the product giving rise to the claim
● We are not responsible for adverse reactions, allergies, or interactions with medications
● You assume all risk associated with using our products
● Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these
limitations may not apply to you
Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances
beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes,
acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of
transportation, facilities, fuel, energy, labor, or materials.
10. Indemnification
You agree to defend, indemnify, and hold harmless Wave, LLC, its officers, directors, employees,
agents, licensors, and suppliers from and against any and all claims, damages, obligations, losses,
liabilities, costs, debts, and expenses (including but not limited to attorney’s fees) arising from:
● Your use or misuse of our products
● Your violation of these Terms
● Your violation of any third-party rights, including intellectual property rights or privacy rights
● Any content or information you provide
● Any harm caused by your actions to any third party
● Any claims that your use of our products caused injury or harm to you or any third party
This indemnification obligation will survive the termination of these Terms and your use of our products.
11. Dispute Resolution and Governing Law
Governing Law: These Terms are governed by the laws of the State of California, without regard to its
conflict of law provisions.
Arbitration Agreement: You and Wave, LLC agree that any dispute, claim, or controversy arising out of
or relating to these Terms or your use of our products shall be settled by binding arbitration administered
by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration
shall be conducted in California, and judgment on the arbitration award may be entered in any court
having jurisdiction.
Class Action Waiver: YOU AND Wave, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST
THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS
MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and
Wave, LLC agree otherwise, the arbitrator may not consolidate more than one person’s claims and may
not otherwise preside over any form of a representative or class proceeding.
Jury Trial Waiver: YOU AND Wave, LLC HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY
RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY. You and
Wave, LLC are instead electing that all claims and disputes shall be resolved by arbitration.
Statute of Limitations: You agree that regardless of any statute or law to the contrary, any claim or
cause of action arising out of or related to use of our products or these Terms must be filed within one (1)
year after such claim or cause of action arose or be forever barred.
Attorney’s Fees: In any arbitration or legal proceeding, the prevailing party shall be entitled to recover its
reasonable attorney’s fees and costs from the non-prevailing party.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon
posting. Your continued use of the website constitutes acceptance of modified Terms. It is your
responsibility to review these Terms periodically.
13. Electronic Communications
By using our website or purchasing our products, you consent to receive electronic communications from
us. These communications may include notices about your account, promotional materials, and other
information concerning our products. You agree that any notices, agreements, disclosures, or other
communications that we send to you electronically will satisfy any legal communication requirements,
including that such communications be in writing.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full
effect.
